Terms of Service

Acceptance: This Rental Agreement becomes effective on the date payment is submitted and is entered into between North Houston Event Rentals LLC (“Company”) and the Customer. By submitting payment, the Customer acknowledges that they have read, understood, and agreed to be bound by all terms and conditions in this Agreement.

Cancellation Policy: Orders canceled more than seven (7) days before the scheduled event date are eligible for a one hundred percent (100%) refund of amounts paid. Orders canceled within seven (7) days of the scheduled event date will incur a cancellation fee equal to fifty percent (50%) of the total rental amount. Orders canceled less than twenty-four (24) hours before the scheduled event date, or on the event date, are non-refundable, and the Customer will be responsible for one hundred percent (100%) of the total rental amount. If cancellation results from an unforeseeable event beyond the Customer’s reasonable control, including but not limited to natural disasters, severe weather, fire, government restrictions, or venue unavailability, North Houston Event Rentals LLC may, at its sole discretion, may issue a credit equal to the amount paid. Any approved credit must be used within one (1) year of the original event date and is subject to availability.

Union Labor and Venue Restrictions: The Customer is solely responsible for all venue requirements, including but not limited to union labor, permits, insurance requirements, loading dock access, security clearances, special handling rules, and any associated venue fees. North Houston Event Rentals LLC is not responsible for arranging, coordinating, or paying for such requirements. Any delays, restricted access, waiting time, or additional labor caused by venue requirements may result in additional charges payable by the Customer.

Drop-Off Requirements: A valid government-issued photo ID matching the booking details must be presented by the Customer or an authorized representative at the time of delivery before any items will be released.

Inspection of Order: The Customer must inspect all rental items at the time of delivery or pickup. By signing the delivery confirmation, the Customer acknowledges that all items were received in acceptable condition. The Customer assumes full responsibility for all items once delivered, including loss, theft, damage, misuse, or weather-related damage, excluding normal wear and tear. Any damages or missing items may be charged up to the full replacement value.

Delivery and Transportation: The Customer is responsible for providing accurate delivery, setup, and pickup information at the time of booking and must disclose any conditions that may impact access or service, including stairs, elevators, narrow entryways, uneven surfaces, long carrying distances, or restricted venue access. Additional fees may apply if undisclosed conditions require extra labor, equipment, time, or personnel.

Rental Period: Rental items must remain at the agreed delivery location unless prior written approval is provided by North Houston Event Rentals LLC. Any extension beyond the agreed rental period will be charged at one hundred percent (100%) of the original daily rental rate per additional day. Items not returned or made available for pickup within ten (10) days after the scheduled pickup date may be considered lost, and the Customer may be charged the full replacement cost of the items, along with any related collection costs, transportation fees, and legal or recovery expenses permitted by law.

Liability and Indemnification: The Customer assumes full responsibility for the use and condition of all rented items during the rental period. The Customer agrees to indemnify, defend, and hold harmless North Houston Event Rentals LLC, its owners, employees, contractors, and agents from any claims, damages, losses, liabilities, or expenses arising from the use, possession, transportation, setup, or operation of the rented items, except to the extent caused by the Company’s gross negligence or willful misconduct. The Company is not liable for indirect, incidental, or consequential damages, including delays caused by weather, traffic, venue restrictions, or other circumstances beyond its reasonable control.

Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising under this Agreement shall be brought in a court of competent jurisdiction in Texas.

Entire Agreement: This Agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous agreements, representations, or understandings, whether written or oral, relating to the subject matter herein.

Amendments and Extra Orders: Any modification, amendment, or additional order must be made in writing and approved by North Houston Event Rentals LLC.

Severability: If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.
